Conditions Générales d’Utilisation
en vigueur au 09/04/2022

Cette page décrit les conditions générales d’utilisation  (ci-après « CGU ») ayant pour objet l’encadrement juridique des dispositions applicables à l’ensemble des utilisateurs de l’application  Diab'App (ci-après « l’Application »). Ces CGU constituent un contrat entre Vous (désigné ci-après par « Vous » ou l’« Utilisateur », et, par renvoi, par « Votre » ou « Vos ») et Diab'App, et encadrent les CGU de l’Application.

Si Vous refusez ces CGU, veuillez ne pas utiliser l’Application.
En utilisant l’Application, Vous acceptez l’ensemble des dispositions des CGU. Diab'App Vous recommande de bien les lire.

Les CGU comprennent :

  • Les dispositions générales (article 1)
  • Les mentions légales et propriété intellectuelle (article 2)
  • Les autorisations requises (article 3)
  • La politique de confidentialité (article 4)

Diab'App se réserve le droit de modifier les présentes CGU et d’imposer, à tout moment et sans préavis, de nouvelles CGU applicables à Votre utilisation de l'Application. Lesdites modifications et conditions supplémentaires prendront effet immédiatement et seront intégrées aux présentes CGU. Votre utilisation de l'Application par la suite sera considérée comme une acceptation tacite de ces CGU.

1. Dispositions Générales

1.1. A propos de l’Application

L’Application est une solution personnelle, développée par Diab'App dont l’objectif unique est d’aider l’Utilisateur à obtenir une information pour calculer plus facilement les unités d’insuline en fonction de la masse de glucides ingérés.

1.2. Avertissement

L’utilisation de l’Application est strictement réservée aux patients diabétiques ainsi qu’aux professionnels de santé. L’Application ne constitue qu’un outil d’information et en aucun cas un outil de diagnostic, de conseil médical. L’Application ne fournit aucune indication en lien avec le traitement que l’Utilisateur pourrait suivre.

Diab'App n’a ainsi aucun contrôle sur l’utilisation de l’Application par l’Utilisateur, ou sur une quelconque interprétation ou utilisation que l’Utilisateur ferait d’une ou plusieurs informations présentées dans l’Application. L’Utilisateur est seul responsable d’examiner et d’évaluer la pertinence, par rapport à sa situation, des informations présentées dans, et générées par l’Application.

L’Application n’a aucune finalité de diagnostic, de prévention, de contrôle, de traitement ou d'atténuation du diabète.

L’Application et les informations qu’elle présente ou génère ne sont pas destinées à se substituer à un avis, un diagnostic ou un traitement médical professionnel. L’Utilisateur doit toujours consulter un professionnel de santé qualifié pour toute question concernant son diabète. L’Utilisateur ne doit jamais ignorer le conseil médical d’un professionnel de santé, ni différer l’obtention de ce conseil en raison d’une quelconque information dont l’Utilisateur aurait eu connaissance de par son utilisation de l’Application.

L’Utilisateur comprend et accepte être entièrement responsable de ses décisions en matière de santé, y compris prises sur le fondement de son utilisation de l’Application.

1.3 Informations contenues dans l'Application

L’Application n’a pas vocation à Vous fournir des conseils médicaux. Les informations relatives à la santé qu’elle peut contenir ne sont fournies que dans l’objectif défini à l’article 1.1 et ne peuvent en aucun cas se substituer à l’avis d’un professionnel de santé. Vous ne devez pas utiliser les informations contenues dans l’Application pour réaliser un diagnostic lié à Votre état de santé, à un problème de condition physique ou à une maladie. Dans tous les cas, Vous devez toujours consulter Votre professionnel de santé.

Vous pouvez consulter l’Application, imprimer des éléments présentés ou contenus dans l’Application, ou encore utiliser tout matériel téléchargé depuis l’Application, à des fins personnelles et pour un usage privé uniquement. En conséquence, Vous ne pouvez utiliser aucun élément de l’Application à d’autres fins, y compris pour une utilisation publique et/ou commerciale, sans avoir obtenu l’accord préalable et écrit de Diab'App

L’Application est exclusivement conçue pour une utilisation personnelle et privée.

Ainsi, il Vous est interdit de procéder à une quelconque copie de tout ou partie du contenu de l’Application à destination d’une tierce personne ou d’autoriser une tierce personne à utiliser l’Application.

L’Application ne contient aucune publicité. Mais des liens hypertextes peuvent être présents sur l’Application. L’Utilisateur est informé qu’en cliquant sur ces liens, il sortira de l’Application. Diab’App n’a pas de contrôle sur les pages web sur lesquelles aboutissent ces liens et ne saurait, en aucun cas, être responsable de leur contenu.

1.4. Limitation de responsabilité

Dans les conditions permises par la loi, Diab'App décline toute responsabilité :

  • pour toute imprécision, inexactitude ou omission relative aux informations disponibles dans l’Application ;
  • pour tout dommage résultant d’une intrusion frauduleuse par un tiers ayant entraîné une modification des informations ou éléments disponibles dans l’Application ;
  • pour tout dommage résultant d’une contamination de la Solution, notamment, mais pas uniquement, par des ‘virus’, ‘chevaux de Troie’ ou autres ‘parasites’ ;
  • et plus généralement, pour tout dommage, direct ou indirect, spécial, consécutif ou accessoire, quelle(s) que soi(en)t sa/ses cause(s), origine(s), nature(s) ou conséquence(s), quand bien même Diab'App aurait eu connaissance de la possibilité de tels dommages causés en raison (i) de l'accès ou de l'impossibilité d'accéder à l’Application , (ii) de l'utilisation de l’Application, incluant toutes détériorations ou virus qui pourraient infecter Votre ordinateur, Votre matériel informatique ou d'autres biens, et / ou (iii) du crédit accordé à une quelconque information provenant directement ou indirectement de l'Application.

1.5 Disponibilité de l’Application

L’application et le site internet sont gratuits à tout Utilisateur ayant un accès à Internet. Tous les frais supportés par l'Utilisateur pour accéder à l’Application ou au site internet (matériel informatique, logiciels, connexion Internet, etc.) sont à sa charge.

Vous reconnaissez :

  • qu’il est techniquement impossible de fournir une Application exempte de tout défaut et que Diab’App ne peut s’y engager ;
  • que ces défauts peuvent rendre temporairement indisponible l’Application ;
  • et que le fonctionnement de l'Application peut être affecté.

Diab'App se réserve le droit à tout moment, sans préavis et à sa seule discrétion, de mettre à jour ou de modifier ou de supprimer, tout ou partie de l’Application, temporairement ou de façon permanente, y compris pour effectuer des travaux de maintenance ou des améliorations ou des changements dans l’Application. Diab'App n'est pas responsable des conséquences de ces modifications, suspensions ou interruptions.

Diab'App se réserve également le droit de mettre un terme à la mise à disposition de l'Application à tout moment, sans préavis sans que Vous ne puissiez revendiquer une quelconque indemnité.

1.6 Langages

Les Conditions d’Utilisation sont disponibles en français (Elles sont traduites en anglais et en hongrois pour votre confort mais seule la version française fait référence). L’Application est disponible en français en anglais et en hongrois.

L’Application a été développée par Diab'App. L'Application ainsi que l'ensemble des droits de propriété intellectuelle associés, les droits d'auteur, marques, dessins, logos, savoir-faire, et tous les autres droits de propriété intellectuelle (déposés ou non), associés à l'Application, sont protégés par la législation en vigueur et appartiennent à Diab'App.

Diab'App vous consent une licence limitée, non-exclusive, incessible, personnelle pour installer, accéder et utiliser l’Application conformément aux dispositions contenues dans les CGU. Cette licence Vous est accordée pendant toute la durée de protection des droits de propriété intellectuelle associés à l’Application, et ce partout dans le monde, dans l’unique but de pouvoir utiliser l’Application.

L'Utilisateur doit solliciter l'autorisation préalable et écrite de Diab’App pour copier reproduire, modifier, republier, altérer, transmettre ou distribuer d’une quelconque manière, sur quelque support que ce soit, en partie ou en totalité, l’Application ou des éléments de l’Application et les droits de propriété intellectuelle associés

L’Utilisateur ne doit pas décompiler, procéder à de l’ingénierie inverse, désassembler l'Application ou désactiver une fonctionnalité qui pourrait limiter l'utilisation de l'Application. L'Utilisateur ne doit pas modifier, adapter, traduire, accorder une sous-licence, louer, prêter, vendre ou distribuer l'Application ni les droits de propriété intellectuelle attachés à l’Application, ou créer des œuvres dérivées de l’Application ou une partie de celle-ci sans le consentement préalable et écrit de Diab'App.

3. Autorisations requises

Lors de l'utilisation de l'Application, il Vous sera demandé l'autorisation d'accéder à Vos contacts pour pouvoir sélectionner les numéros de téléphone à qui Vous souhaitez que l'Application envoie des rapports. Ces rapports seront envoyés uniquement si Vous le demandez, à ce moment il faudra une validation de Votre part pour envoyer un SMS.

L'Application aura besoin d'accéder à internet pour télécharger la table Ciqual (Anses. 2020. Table de composition nutritionnelle des aliments Ciqual. Consulté le 01/03/2022.  https://ciqual.anses.fr/ ) qui correspond à Votre langue au lancement de l'Application  (puis à chaque fois que Vous changez de langue). Puis une fois chargée dans l'appareil la connexion internet n'est plus nécessaire et l'Application peut fonctionner hors ligne.

Cette politique de confidentialité (ci-après la « Politique ») définit les conditions qui s’appliquent aux informations que Vous entrez dans l’application « Diab'App » (ci-après « l’Application ») lors de son utilisation.

Si Vous n’êtes pas d’accord avec l’un ou plusieurs des termes de cette Politique, veuillez ne pas utiliser l’Application.
En utilisant l’Application, Vous acceptez la Politique. Diab'App Vous remercie de lire attentivement les termes ci-dessous.

La politique de confidentialité apparaît lors de Votre première utilisation de l’Application et à chaque mise à jour de l’Application. Vous pouvez ensuite accéder à cette Politique via https://diabapp.com.

Cette Politique pourra être modifiée par Diab'App au fil du temps, en particulier pour l’adapter aux évolutions ou aux changements du droit applicable. Les changements figureront sur https://diabapp.com. Nous Vous invitons à consulter cette Politique régulièrement.

Diab'App n’a aucun accès aux données personnelles que Vous entrez dans l’Application via ces appareils mobiles, ni ne peut en récupérer une copie pour Votre compte. Il n'y a aucun envoi de données à des tiers. Diab’App est exempté de déclaration à la Commission Nationale Informatique et Libertés (CNIL) dans la mesure où il ne collecte aucune donnée concernant les Utilisateurs.

Les données que Vous entrez dans l’Application, y compris Vos données personnelles, restent logées dans les appareils mobiles que Vous utilisez pour accéder et Vous servir de l’Application. Ces données personnelles restent dans Votre appareil mobile et sont supprimées lorsque Vous désinstallez l’Application.

Terms of Services

This page describes the terms of service (hereafter " TOS ") having for object the legal framework of the provisions applicable to all users of the Diab'App application (hereafter " the Application ") . These TOS constitute a contract between You (hereinafter referred to as " You " or the " User ", and, by reference, by " Your " or " Your ") and Diab'App , and govern the TOS of the Application .

If You refuse these Terms, please do not use the Application.
By using the Application, you accept all the provisions of the TOS. Diab'App recommends that you read them carefully.

The TOS include:

  • General provisions (article 1)
  • Legal notices and intellectual property (article 2)
  • Authorizations required (article 3)
  • The privacy policy (article 4)

Diab'App reserves the right to modify these TOS and to impose, at any time and without notice, new TOS applicable to Your use of the Application. Such modifications and additional terms will take effect immediately and will be incorporated into these TOS. Your use of the Application thereafter will be considered as a tacit acceptance of these TOS.

1. General Provisions

1.1. About the App

The Application is a personal solution, developed by Diab'App whose sole objective is to help the User obtain information to more easily calculate insulin units according to the mass of carbohydrates ingested.

1.2. Warning

The use of the Application is strictly reserved for diabetic patients and healthcare professionals. The Application is only an information tool and in no way a tool for diagnosis or medical advice. The Application does not provide any indication related to the treatment that the User could follow.

Diab'App thus has no control over the use of the Application by the User, or over any interpretation or use that the User may make of one or more information presented in the Application. The User is solely responsible for examining and evaluating the relevance, in relation to his situation, of the information presented in and generated by the Application.

The Application has no purpose of diagnosing, preventing, controlling, treating or alleviating diabetes.

The Application and the information it presents or generates are not intended to be a substitute for professional medical advice, diagnosis or treatment. The User must always consult a qualified health professional for any question concerning his diabetes. The User must never ignore the medical advice of a health professional, nor delay obtaining this advice because of any information of which the User would have become aware through his use of the Application.

The User understands and accepts to be entirely responsible for his decisions in terms of health, including those taken on the basis of his use of the Application.

1.3 Information contained in the Application

The Application is not intended to provide You with medical advice. The information relating to health that it may contain is only provided for the purpose defined in article 1.1 and can in no way replace the advice of a health professional. You must not use the information contained in the Application to make a diagnosis related to Your state of health, a physical condition problem or an illness. In any case, You should always consult Your healthcare professional.

You can consult the Application, print elements presented or contained in the Application, or use any material downloaded from the Application, for personal purposes and for private use only. Consequently, You may not use any element of the Application for other purposes, including for public and/or commercial use, without having obtained Diab'App 's prior written consent.

The Application is exclusively designed for personal and private use.

Thus, You are prohibited from making any copy of all or part of the content of the Application intended for a third party or from authorizing a third party to use the Application.

The Application does not contain any advertising. But hypertext links may be present on the Application. The User is informed that by clicking on these links, he will leave the Application. Diab'App has no control over the web pages to which these links lead and cannot, under any circumstances, be responsible for their content.

1.4. Limitation of Liability

Under the conditions permitted by law, Diab'App declines all responsibility :

  • for any imprecision, inaccuracy or omission relating to the information available in the Application;
  • for any damage resulting from fraudulent intrusion by a third party leading to a modification of the information or elements available in the Application;
  • for any damage resulting from contamination of the Solution, in particular, but not exclusively, by 'viruses', 'Trojan horses' or other 'parasites';
  • and more generally, for any direct or indirect, special, consequential or incidental damage, whatever its cause(s), origin(s), nature(s) or consequence(s) , even if Diab'App would have been aware of the possibility of such damages caused due to (i) access or the impossibility of accessing the Application, (ii) the use of the Application , including any deterioration or virus that could infect Your computer, Your computer equipment or other property, and / or (iii) the credit given to any information coming directly or indirectly from the Application.

1.5 Application Availability

The application and the website are free to any User with Internet access. All costs borne by the User to access the Application or the website (hardware, software, Internet connection, etc.) are his responsibility.

You recognize :

  • that it is technically impossible to provide an Application free from any defect and that Diab'App cannot undertake to do so;
  • that these faults may make the Application temporarily unavailable;
  • and that the operation of the Application may be affected.

Diab'App reserves the right at any time, without notice and at its sole discretion, to update or modify or delete all or part of the Application, temporarily or permanently, including to carry out work maintenance or improvements or changes to the Application. Diab'App is not responsible for the consequences of these modifications, suspensions or interruptions.

Diab'App also reserves the right to terminate the provision of the Application at any time, without notice, without You being able to claim any compensation.

1.6 Languages

The Terms of Use are available in French (They are translated into English and Hungarian for your convenience but only the French version refers). The Application is available in French, English and Hungarian.

The Application was developed by Diab'App . The Application as well as all associated intellectual property rights, copyrights, trademarks, designs, logos, know-how, and all other intellectual property rights (registered or not), associated with the Application , are protected by the legislation in force and belong to Diab'App .

Diab'App grants you a limited, non-exclusive, non-transferable, personal license to install, access and use the Application in accordance with the provisions contained in the TOS. This license is granted to You for the entire duration of the protection of the intellectual property rights associated with the Application, and this anywhere in the world, for the sole purpose of being able to use the Application.

The User must seek Diab'App 's prior written authorization to copy, reproduce, modify, republish, alter, transmit or distribute in any way, on any medium whatsoever, in part or in whole, the Application. or elements of the Application and the associated intellectual property rights

The User must not decompile, reverse engineer, disassemble the Application or disable any functionality that could limit the use of the Application. The User must not modify, adapt, translate, sublicense, rent, lend, sell or distribute the Application or the intellectual property rights attached to the Application, or create works derived from the Application or part of it without the prior written consent of Diab'App .

3. Permissions Required

When using the Application, You will be asked for permission to access Your contacts to be able to select the phone numbers You want the Application to send reports to. These reports will only be sent if You request it, at which time You will need a validation from You to send an SMS .

The Application will need internet access to download the Ciqual table ( Anses. 2020. Table of nutritional composition of Ciqual foods . Consulted on 01/03/2022. https://ciqual.anses.fr/ ) which corresponds to Your language when the Application is launched (then each time You change language). Then once loaded in the device the internet connection is no longer necessary and the Application can work offline.

4. Privacy Policy

This privacy policy (hereinafter the " Policy ") defines the conditions that apply to the information that you enter into the " Diab'App " application (hereinafter the "Application ") when using it.

If you disagree with one or more of the terms of this Policy, please do not use the Application.
By using the Application, you agree to the Policy. Diab'App thanks you for carefully reading the terms below.

The privacy policy appears when you first use the Application and each time the Application is updated. You can then access this Policy via https://diabapp.com.

This Policy may be modified by Diab'App over time, in particular to adapt it to developments or changes in applicable law. Changes will be posted on https://diabapp.com. We encourage you to review this Policy regularly.

Diab'App has no access to the personal data that you enter into the Application via these mobile devices, nor can it retrieve a copy for your account. There is no sending of data to third parties. Diab'App is exempt from reporting to the National Commission for Computing and Liberties (CNIL) insofar as it does not collect any data concerning Users.

The data you enter into the Application, including your personal data, remains stored in the mobile devices you use to access and use the Application. This personal data remains in your phone and is deleted when you uninstall the Application.

2022.09.04-én hatályos Általános Felhasználási Feltételek
 

Ez az oldal az általános használati feltételeket (a továbbiakban " TOS ") írja le, amelyek tárgya a Diab'App alkalmazás (a továbbiakban: " Alkalmazás ") valamennyi felhasználójára vonatkozó rendelkezések jogi kerete . Ezek az Általános Szerződési Feltételek szerződést alkotnak Ön (a továbbiakban: „ Ön ” vagy „ Felhasználó ”, hivatkozásként az „ Ön ” vagy „ Ön ”) és a Diab'App között, és szabályozzák az Alkalmazás Általános Szerződési Feltételeit.

1. Általános rendelkezések

1.1. Az alkalmazásról

Diab'App által kifejlesztett személyes megoldás, amelynek egyetlen célja, hogy segítse a Felhasználót az inzulinegységek könnyebb kiszámításához az elfogyasztott szénhidrátok tömege alapján.

1.2. Figyelem

Az Alkalmazás használata szigorúan cukorbetegek és egészségügyi szakemberek számára van fenntartva. Az Alkalmazás csak egy információs eszköz, semmiképpen sem diagnózis vagy orvosi tanácsadás eszköze. Az Alkalmazás nem ad tájékoztatást a Felhasználó által követhető kezeléssel kapcsolatban.

A Diab'App tehát nem rendelkezik befolyással az Alkalmazás Felhasználó általi használatára, illetve az Alkalmazásban szereplő egy vagy több információ Felhasználó általi értelmezésére vagy felhasználására. A Felhasználó kizárólagos felelőssége az Alkalmazásban közölt és az általa generált információk saját helyzetével kapcsolatos relevanciájának vizsgálata és értékelése.

Az alkalmazásnak nem célja a cukorbetegség diagnosztizálása, megelőzése, ellenőrzése, kezelése vagy enyhítése.

Az Alkalmazás és az általa bemutatott vagy generált információk nem helyettesíthetik a professzionális orvosi tanácsot, diagnózist vagy kezelést. A Felhasználónak mindig konzultálnia kell egy képzett egészségügyi szakemberrel a cukorbetegségével kapcsolatos bármilyen kérdésben. A Felhasználó soha nem hagyhatja figyelmen kívül egészségügyi szakember orvosi tanácsát, és nem halogathatja a tanács megszerzését olyan információ miatt, amelyről az Alkalmazás használata során a Felhasználó tudomást szerzett volna.

A Felhasználó tudomásul veszi és elfogadja, hogy teljes mértékben felelősséggel tartozik egészségileg hozott döntéseiért, beleértve azokat is, amelyeket az Alkalmazás használata alapján hozott.

1.3 Az Alkalmazásban szereplő információk

Az alkalmazás célja nem az, hogy orvosi tanácsot adjon Önnek. Az egészséggel kapcsolatos információkat, amelyeket tartalmazhat, csak az 1.1. cikkben meghatározott célra adják, és semmiképpen sem helyettesíthetik az egészségügyi szakember tanácsát. Nem használhatja fel az Alkalmazásban található információkat egészségi állapotával, testi állapot problémájával vagy betegségével kapcsolatos diagnózis felállítására. Mindenesetre mindig konzultáljon egészségügyi szakemberével.

Személyes célokra és kizárólag magáncélra tekintheti meg az Alkalmazást, nyomtathat az Alkalmazásban bemutatott vagy benne foglalt elemeket, illetve felhasználhat az Alkalmazásból letöltött anyagokat. Következésképpen Ön az Alkalmazás egyetlen elemét sem használhatja más célokra, beleértve a nyilvános és/vagy kereskedelmi célokat is, a Diab'App előzetes írásbeli hozzájárulása nélkül.
